A prenuptial agreement is a contract between two people planning to get married who wish to "opt out" of New York's equitable distribution, spousal support and/or inheritance laws. It should be thought of as a road map by which the parties plan to live their financial lives. In the past, prenuptial agreements were used mainly by people embarking upon second marriages or people who come from great wealth. However, a well-crafted prenuptial agreement is helpful to anyone planning on getting married who has assets or income to protect now, or in the future.
In order to protect the validity of the agreement in case of a challenge during a divorce, parties considering a prenuptial agreement should:
1. Each have his or her own attorney;
2. Make sure there is plenty of time before the wedding;
3. Each complete a financial disclosure affidavit, listing each party's expenses, income, assets and liabilities.
Failure to adhere to each of the above points could result in the agreement being invalidated.
